TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your use of the PR|FIS Field Investigation System mobile application and the ODPSI web platform (together, the "Service"), operated by ODPSI ("we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. WHO WE ARE

ODPSI — the Office of the Director of Paranormal and Supernatural Intelligence — is a private organization. We are not a government agency and have no affiliation with, endorsement by, or connection to any government organization or entity at any level. Any directorial or agency terminology is organizational and thematic in nature.

3. ELIGIBILITY

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and make purchases. If you are a minor, you may use the Service only with the involvement and consent of a parent or legal guardian.

4. THE SERVICE

The Service provides electromagnetic (EMF) and audio investigation tools, evidence logging and reporting, optional cloud backup, and related community features. The Service is provided for informational and entertainment purposes.

The website maps include an access status for each location, DIRECTIONS, NEAR ME, saved places, and, for paid members, a satellite view. Which features are included in each tier may change.

5. ACCOUNTS & SECURITY

You are responsible for the credentials to your account and for all activity under it. Keep your password confidential and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

6. SUBSCRIPTIONS, BILLING & AUTO-RENEWAL

Paid tiers (currently Operative at $3/month and Specialist at $10/month) are billed in advance on a recurring monthly basis through our payment processor, Stripe. Your subscription renews automatically until you cancel.

You may cancel at any time from your account; access to paid features continues through the end of the current billing period. Prices may change with notice; changes apply to subsequent billing periods. See our Refund Policy for refund terms.

7. YOUR CONTENT & EVIDENCE

You retain ownership of the investigation data, recordings, and media you create ("Your Content"). By using cloud backup, you grant us a limited license to store, process, and transmit Your Content solely to operate the Service for you. You are responsible for ensuring you have the right to record and upload Your Content.

8. ACCEPTABLE USE & LEGAL CONDUCT

You agree not to misuse the Service or use it for any unlawful purpose. ODPSI does not condone trespassing, breaking and entering, vandalism, or any other illegal activity in connection with the Service. You are solely responsible for ensuring you have lawful permission to access and investigate any location.

PROHIBITED CONTENT. By entering the Service you acknowledge and agree that nudity, sexual content, depictions of drug use, and violence or gore are prohibited in anything you submit, upload, publish, or share — including evidence, media, location entries, community reports, group libraries, profiles, and chat. The single exception is material that is historically accurate and germane to the documented history of a location or case: a site's recorded history of violence, a documented death, or an archival image may be described or presented factually and without sensationalism. This exception covers historical documentation only. It does not permit gratuitous, recreational, or gratifying depictions of the same subjects, and it never permits sexual content or any material involving minors.

IMAGES AND PROFILE PICTURES. No inappropriate images, anywhere on the Service. This applies to your profile picture and to every image or video you upload — evidence, location and record photos, community reports, group libraries, articles, chat and messages. Your profile picture must be a photo of you or a symbol or emblem that represents you, and must not show nudity or sexual content, drug use, violence or gore, hate symbols or hateful imagery, another real person without their consent, a minor other than yourself, or anything that impersonates another person or organisation. Uploaded images must follow the prohibited content rules above and must be images you have the right to share. The Director's office may remove any image that breaks this section, including a profile picture, without notice; the Director's office may also give the account a warning (see WARNINGS below).

We may remove any content that breaches this section, and may suspend or terminate the account responsible, at our discretion and without notice. Anyone may flag content for review using the report control on the page that shows it; reports are reviewed by the Director's office and are not actioned automatically.

WARNINGS. A report on its own never counts against you. When the Director's office takes down something you posted because it breaks these Terms, your account receives a warning, and you are told what was taken down and why. At three active warnings your account may be suspended. You may appeal any warning from the notification that tells you about it, and a successful appeal removes the warning from your record. A suspension lifts once you fall below three active warnings. Removal for an honest mistake, such as a duplicate entry, does not carry a warning.

WRITING IN THE LIBRARY. Pieces written for the Library's LongForm section are published as soon as their author publishes them. ODPSI does not review them beforehand, and the author alone is responsible for what a piece says. Every piece must follow these Terms, including the prohibited content rules above, and must be the author's own work, with anything drawn from others quoted and cited. Plagiarised, stolen, leaked or private material is prohibited, and so are false statements of fact about real people, places or businesses. Every published piece carries a report control that any reader may use. The Director's office reviews every report and may edit a piece for clarity, take it down, or suspend or terminate the author's account, at its discretion and without notice. A piece that has been taken down returns only if the Director's office publishes it again. Publication does not mean ODPSI endorses, verifies or agrees with a piece.

9. SAFETY

Investigating unknown, abandoned, or dangerous locations may result in serious injury or death. You assume all risk. Always prioritize your personal safety and never investigate alone in dangerous or unfamiliar locations. ODPSI is not responsible for any injury, death, property damage, or other harm incurred while using the Service.

10. MAP INFORMATION, ACCESS STATUS & DIRECTIONS

The access status shown for a location (PUBLIC, TOURS ONLY, RESTRICTED, EXTERIOR ONLY, NO ACCESS or UNKNOWN) and any access note are taken from the location’s own record and from public sources. They are a guide only. They may be out of date or wrong, and they are never permission to enter any property. Opening hours, ownership and access change. Check with the owner or operator before you travel, and obey posted signs and local law.

A private residence or private property must be viewed only from a public place. Do not enter, knock, photograph occupants, or disturb the people who live or work there.

DIRECTIONS and the satellite view are provided by third parties (Google Maps or Apple Maps, and Esri). Routes, positions and imagery may be inaccurate or out of date. Follow road signs and use your own judgment. NEAR ME distances are straight-line estimates, not travel distances.

11. INTERPRETATION DISCLAIMER

All interpretations of any readings, data, or findings produced by the Service are solely the responsibility of the user. ODPSI does not promote, prove, validate, or make any claims regarding the existence of paranormal or supernatural phenomena. Readings reflect sensor measurements and are not evidence of the paranormal.

12. DISCLAIMER OF WARRANTIES

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, accurate, or error-free.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, ODPSI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

14. TERMINATION

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination will survive.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. Material changes will be posted with a new effective date. Your continued use of the Service after changes take effect constitutes acceptance.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Hawaii, United States, without regard to conflict-of-laws principles, except where superseded by mandatory consumer-protection law in your jurisdiction.
